Dear Mr. President:

As you are undoubtedly aware, the states of Florida and South Carolina participated in the twenty-six state constitutional challenge to the Affordable Care Act (Act). Not only did we have serious misgivings as to the constitutional validity of the Act, but also we were concerned that despite your promises to the contrary, the Act would not allow Americans to keep their existing health care plans. Additionally, we correctly believed that rather than bringing clarity to the health care market place, the Act would produce chaos for millions of Americans, health care consumers and the business community alike.

Since the Supreme Court decision, we have recently expressed a number of concerns to your Administration regarding implementation of the Act. These fears have gone unaddressed. For example, last August, thirteen states documented to Secretary Sebelius a list of specific security and consumer safety issues and questions related to the Navigators program. Additional concerns related to Healthcare.gov were memorialized in Congressional testimony. However, your Administration has yet to provide any meaningful response.

Due to the lack of response to the multitude of concerns shared with your Administration by numerous states over the last several months, we are requesting you to direct Secretary Sebelius to meet with the concerned attorneys general to address these issues. Additionally, we request your support for Congressional action to allow all Americans to keep their existing health care plans. Your Administration made this promise to the American people and that promise should be kept.
