SC Attorney General Alan Wilson joins 44-state coalition in motion to unseal generic drug price fixing complaint

(COLUMBIA, S.C.) – June 6, 2019 - South Carolina Attorney General Alan Wilson joined a 44-state coalition led by Connecticut Attorney General William Tong in a motion today to unseal their complaint against Teva Pharmaceuticals and 19 of the nation's largest generic drug manufacturers. The complaint, filed on May 10 in U.S. District Court for the District of Connecticut, alleges a broad conspiracy to artificially inflate and manipulate prices, reduce competition and unreasonably restrain trade for more than 100 different drugs.

“We announced our part in this lawsuit last month and now we want people to be able to see this evidence,” Attorney General Wilson said. “This case is about protecting consumers in South Carolina and nationwide and there’s no reason the evidence should remain sealed.”

This complaint is the second to be filed in an ongoing, expanding investigation that the Connecticut Office of the Attorney General has referred to as possibly the largest cartel case in the history of the United States. The first complaint was similarly filed under seal initially, and later released in full with permission from the court.

"We are moving to unseal this complaint because the public deserves to see the evidence we have. We all ask ourselves why drug prices are so high, and these redacted emails and other records go a long way to answering that enduring question. We are proceeding aggressively with this case, as well as our expanding and ongoing industry-wide investigation. The companies and individuals who orchestrated this scheme must be held accountable," said Attorney General William Tong.
