Attorney General Alan Wilson announces arrest of Seneca woman for fraud, exploitation of vulnerable adult

(COLUMBIA, S.C.) – South Carolina Attorney General Alan Wilson announces that his office’s Medicaid Fraud Control Unit (SCMFCU) has arrested Misty A. Revis, 37 years old, of Seneca, SC for Exploitation of a Vulnerable Adult {43-35-0085 (D)} and Financial Transaction Card Fraud {16-14-60(a)(2)(b)}. Revis was booked into the Oconee County Detention Center on January 13, 2023.

An SCMFCU investigation revealed that between December 3, 2021 and May 31, 2022, Revis converted the victim’s funds to her own use. The victim, a vulnerable adult under South Carolina law, was an inpatient at Oconee Medical Center and later transitioned to Seneca Health and Rehabilitation Center during the time of the alleged misconduct. It is alleged that Revis, unlawfully and without consent, used the victim’s debit card to obtain money, goods and services for Revis’ own benefit. Revis is also accused of using her position as the victim’s power of attorney to willfully make, with fraudulent intent, unlawful and improper use of the victim’s funds and assets.

This case was referred to the SCMFCU for investigation through a citizen complaint. It will be prosecuted by the Attorney General’s Office. 

Exploitation of a Vulnerable Adult is a felony and, upon conviction, has a penalty of not more than five years in prison, a fine not exceeding five thousand dollars, or both. Financial Transaction Card Fraud is a felony and, upon conviction, has a penalty of not more than five years in prison, a fine between three and five thousand dollars, or both.

Pursuant to federal regulations, the SCMFCU has authority over Medicaid provider fraud; abuse and neglect of Medicaid beneficiaries in any setting; and the abuse, neglect, and exploitation of individuals residing in assisted living facilities or nursing homes. 

Attorney General Wilson stressed all defendants are presumed innocent unless and until they are proven guilty in a court of law.

The SCMFCU receives 75 percent of its funding from the U.S. Department of Health and Human Services under a grant award totaling $2,318,568 for federal fiscal year 2023. The remaining 25 percent, totaling $772,852 for FFY 2023, is funded by South Carolina.
