(COLUMBIA, S.C.) – South Carolina Attorney General Alan Wilson applauded the Supreme Court’s ruling today in West Virginia v. EPA, a case involving the Environmental Protection Agency overstepping authority that’s reserved for Congress.
“This is another example of the Biden administration’s overreach, trying to implement rules that it doesn’t have the power to under the Constitution,” Attorney General Wilson said. “We all want clean air and clean water, but it is up to a duly-elected Congress to address climate change, not a group of unelected bureaucrats.”
Chief Justice John Roberts wrote the majority opinion, saying, “Capping carbon dioxide emissions at a level that will force a nationwide transition away from the use of coal to generate electricity may be a sensible ‘solution to the crisis of the day.’ But it is not plausible that Congress gave EPA the authority to adopt on its own such a regulatory scheme in Section 111(d). A decision of such magnitude and consequence rests with Congress itself, or an agency acting pursuant to a clear delegation from that representative body.”
