State Rep. Harold Mitchell, Jr. Pleads Guilty to Two Counts of Failure to File State Tax Returns

(COLUMBIA, S.C. – November 26, 2012) South Carolina Attorney General Alan Wilson announced state Representative Harold Mitchell, Jr. (Spartanburg, District 31) pleaded guilty in Spartanburg County General Sessions Court on Monday, November 26, to two charges of failing to file state tax returns.

Mitchell pleaded guilty to two (2) counts of Failure to File Income Tax Returns (for tax year 2007 for taxes of $2,001.00, and tax year 2008 for taxes of $1,758.00).

Mitchell was sentenced to one year for each count, suspended to three years’ probation and the payment of $5,989.30 for all taxes owed.  Mitchell was also ordered to pay the costs of prosecution, which will be determined at a later date.  The State did not recommend a sentence and left sentencing up to the Court.  The charges carried a maximum potential sentence of up to one year and/or a fine of up to $10,000 for each count.

The case was investigated by the South Carolina Department of Revenue and prosecuted by the South Carolina Attorney General’s Office.
