Asking: if a person is arrested with a warrant issued by a probation agent and taken to any jail in South Carolina, is the jail required to accept the prisoner for detention upon delivery of the prisoner and a copy of the warrant. And assuming the jail is required to accept the prisoner, are there any exceptions to the rule that would allow a jailer to refuse to accept custody?

Requested by: The Honorable Michael J. Cavanaugh, Commissioner, Department of Probation, Parole and Pardon Services
