Regarding an issue arising in two separate situations. Prior to creation of the Coastal Council within the Coastal Zone Management Act, Sections 48-39-10 et seq. of the Code of Laws of South Carolina (1976), the Budget and Control Board issued permits for certain activities to be conducted within navigable tidal waters of this State. The concern is whether the jurisdiction of the Budget and Control Board has been superseded in areas in which the Coastal Council was given jurisdiction by the Coastal Zone Management Act in 1977.
